Terms of Service

These Terms of Service ("Terms") are a legally binding contract between you and EdMyPic ("we", "our", "us") governing your use of the EdMyPic service, the edmypic.com website, the editor, any APIs, and any embedded version of the editor on third-party sites (together, the "Service"). By creating an account or using the Service you agree to these Terms and to the Privacy Policy and Acceptable Use Policy, which are incorporated here by reference.

If you do not agree, do not use the Service.


1. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that (a) you are at least 18, (b) you have the legal capacity to enter into this contract in your jurisdiction, and (c) you are not on any government sanctions or denied-persons list.

Accounts found to be registered by minors will be closed without notice and any paid balance forfeited.


2. The Service

EdMyPic provides AI-powered photo editing and image generation. Outputs are produced by machine-learning models operated by us or by third-party providers (see the Privacy Policy §4). AI outputs are probabilistic and provided "AS IS" - we do not warrant that a given prompt will produce any particular result, that outputs will be free of artefacts, or that outputs will be fit for a particular purpose.


3. Your Account

You are responsible for: (a) keeping your login credentials secret, (b) all activity that occurs on your account, and (c) notifying us immediately at [email protected] if you suspect unauthorised use. We may require re-verification (email confirmation, 2FA, or government ID in limited cases) when we detect suspicious activity.


4. User Content - Your Warranties and Licence

"User Content" means everything you upload to, or generate with, the Service: input images, prompts, and the resulting output images.

You warrant that:

  1. You own or have the necessary rights and permissions to upload every input image and to submit every prompt.
  2. Your User Content does not infringe any third-party intellectual-property right, publicity right, privacy right, or other legal right.
  3. You have obtained the informed consent of every identifiable person whose face appears in an uploaded photo (see §§5 and 12 below).
  4. Your use of the Service complies with all applicable laws in your jurisdiction and in the jurisdiction of any recipient of the output.

Licence you grant us. You grant us a worldwide, royalty-free, non-exclusive licence to host, process, cache, and transmit your User Content solely for the purpose of providing the Service, complying with legal obligations (e.g. moderation, lawful requests), and - in aggregate, anonymised form only - analysing usage to improve the product. We do NOT use your input or output images to train AI models.

Prompt Gallery (Basic AI Create only). If you generate an image using the free Basic model in AI Create (whether as a guest or on a free account), you grant us an additional, perpetual, royalty-free licence to publish that output image on our public Prompt Gallery at /prompt-gallery alongside the prompt you entered, the model name, and the publication date. This applies only to images generated with the Basic Create model; outputs from any paid model, from AI Edit, or generated by users who explicitly opted out (registered users can uncheck the "Publish" toggle) are never added to the public gallery. You may request removal of any of your gallery contributions by emailing [email protected]; removals are processed within 7 days.

Ownership. Subject to §5 and to the terms of the underlying model providers, you own the output images you generate, and you may use them for any lawful purpose (personal or commercial) - but (i) outputs generated from third-party copyrighted material remain subject to that third party's rights, and (ii) US case-law (Thaler v. Perlmutter, 2023; Copyright Office guidance 2023–2025) currently holds that purely AI-generated images may have limited copyright protection; you must perform sufficient human creative input to claim authorship.


5. Acceptable Use

You must comply with our Acceptable Use Policy. Prohibited content includes - without limitation - child sexual abuse material (CSAM, an absolute prohibition), non-consensual intimate imagery (including AI-generated "nudifying" of real people), content depicting real identifiable individuals in a sexually explicit or politically compromising manner without their consent, content inciting violence or terrorism, targeted harassment, IP infringement, and content prohibited by the laws of your jurisdiction.

You agree that you bear sole and full responsibility for any content you submit, generate, or distribute using the Service.

We operate an automated prompt-and-image moderation system (see Privacy Policy §5). False negatives (content that passed the filter but violates policy) do not create any safe-harbour for you: the prompt itself and what you do with the output remain your responsibility.


6. Enforcement

We may, at our sole discretion and without prior notice:

  • Block a prompt or output;
  • Suspend or terminate your account, with or without refund of unused credits;
  • Preserve and share evidence with law enforcement when required by law.

CSAM results in immediate termination and a report to the relevant authority (NCMEC in the US, IWF in the UK, or local equivalents), with preservation of all associated data for at least 90 days.

Strike policy. For non-criminal policy violations we operate a three-strike framework: (1) warning + content removal, (2) temporary 30-day suspension, (3) permanent ban. We may skip strikes for severe or repeated violations.

Appeals. If you believe enforcement was applied in error you may appeal by emailing [email protected] within 30 days. We aim to respond within 14 days.


7. Credits, Plans, and Payment

Free plan. New accounts receive a recurring daily allowance of free credits. Unused daily credits do NOT roll over.

Credit Packs are one-time purchases of a fixed credit balance. Packs never expire. Credits are non-transferable between accounts and have no cash value.

Pro Plan is a recurring subscription billed monthly or annually. You may cancel at any time from your dashboard; access continues until the end of the paid period.

Billing. Payments are processed by Stripe, Inc. We do not store card details. Prices are shown inclusive of applicable VAT where required; other taxes (local sales, use, withholding) are your responsibility.

Refunds. See our Refund Policy. Beyond what that policy provides, credits spent on outputs blocked by moderation are automatically refunded to the account balance.

Price changes. We may change prices with at least 14 days' notice. Price changes do not affect pre-purchased credit packs or the in-flight billing period of an active subscription.


8. Third-Party Embeds

The Service may be embedded on third-party websites. We are not responsible for the policies or conduct of any embedding site. Your use of the editor remains governed by these Terms regardless of where you access it.


9. IP Ownership and Feedback

All rights in the Service, the website, the code, the UI, the brand, and the underlying technology are owned by us or our licensors. These Terms grant you only the right to use the Service; they do not transfer any IP right. Any feedback you send us is non-confidential and we may use it without obligation.


10. DMCA / IP-Takedown

If you believe content generated or hosted through the Service infringes your copyright, send a DMCA notice to [email protected] containing: (a) your contact information; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material (URL + description); (d) a statement made in good faith that use is not authorised; (e) a statement under penalty of perjury that the information is accurate and that you are authorised to act; (f) your physical or electronic signature.

We will respond to complete notices promptly and will terminate repeat infringers' accounts.


11. Indemnification

You agree to defend, indemnify, and hold harmless EdMyPic, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt and expenses (including reasonable attorneys' fees) arising from (i) your use of the Service; (ii) your User Content; (iii) your violation of these Terms or the Acceptable Use Policy; (iv) your violation of any third-party right, including any intellectual-property, privacy, or publicity right; (v) your violation of any applicable law.


12. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Service will be uninterrupted, error-free, secure, or that outputs will meet your requirements. Generative AI may produce inaccurate or harmful results; you are responsible for reviewing outputs before publishing or acting on them.

Nothing in this section limits any warranty that cannot be excluded under the applicable consumer-protection law of your country of habitual residence.


13. Limitation of Liability

To the maximum extent permitted by applicable law, neither we nor our affiliates, licensors, or service providers shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost data; business interruption; reputational harm; or any claim arising out of or relating to the output of the Service - even if advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) USD 100.

Nothing in this section limits liability that cannot be excluded under the law of your country of habitual residence (e.g. liability for gross negligence or wilful misconduct under EU consumer law).


14. Geo-Specific Provisions

  • European Union / EEA. You have the statutory rights described in Directive 2011/83/EU (Consumer Rights). The 14-day withdrawal right does not apply to a subscription once you have used any Service, because the service is then fully performed to that extent - see the Refund Policy.
  • United Kingdom. The UK Online Safety Act 2023 and related regulations apply; we co-operate with Ofcom notices.
  • Germany. § 312d BGB distance-selling provisions and NetzDG reporting obligations apply. A notice to Ofcom/BfJ can be sent to [email protected] with subject "NetzDG".
  • Australia. The Online Safety Act 2021 applies; we respond to eSafety Commissioner notices.
  • China (Mainland). The Generative AI Interim Measures (2023) and the Deep Synthesis Provisions apply; certain content types may be blocked at the network layer without notice.
  • Russia / Sanctioned Jurisdictions. The Service is not available to persons or entities on any US, UK, or EU sanctions list, or to users located in a jurisdiction subject to comprehensive sanctions.

15. Termination

You may close your account at any time from your dashboard. We may suspend or terminate your account as described in §6. On termination, §§4–5, 7 (paid balances), 9–13, 17, and 18 survive.


16. Changes to These Terms

We may modify these Terms. Material changes will be announced in-app at least 14 days before they take effect. The date of the last update appears at the top of this page. Continued use after the effective date constitutes acceptance.


17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Nothing in this section deprives you of the protection afforded to you by the mandatory rules of the country of your habitual residence.

EU consumers may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Class-action waiver / arbitration (US users only). Any dispute that cannot be resolved informally within 60 days shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Rules, in Delaware, USA. You waive any right to participate in a class or collective action. You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms.


18. Miscellaneous

These Terms, together with the Privacy Policy, Acceptable Use Policy, and Refund Policy, constitute the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remainder stays in force. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
